Although I am one of the LOUDEST posters here about wanting new content, I have to disagree with you about not starting a new pirate. I am on my third, and each and every one has been played differently. My first was the one that I learned on. He still has the highest number of enemies defeated and ships sunk, due to me not knowing or fully understanding the game. My second fully mastered in only 9 weeks, and has one of the lowest enemies defeated and ships sunk totals of any fully mastered pirate that I have met. My third, almost fully mastered, has been the most interesting, since I have spent almost none of his skill points, have over 100 unspent, and I have not done ANY of the Pearl quest. Each pirate can be played totally differently, and it gives you a lot of variation.

NOW, I totally agree that level 40 is a major wall. Disney has given us, the customer, almost no reason to continue playing once that has been achieved. It is only due to the ingenuity of the players themselves that the high level pirates stay active. Since Disney hasn't given us anything to do, we have to create our own entertainment. So basically, we are paying Disney not for the content of the game, but for the bandwidth and concept that allows us to create our own game within the game.
