I was nowhere near a jail or had been in it at all but someone I was sailing with didn't get off the ship fast enough he did go to jail after being sunk maybe someone can report this I have no idea who or where to go to.

It's a bug. I've had this happen to me before when I TP'd off a friend's ship right before it sunk. I was proud of myself for making it off but as far as the game was concerned, I died and was in jail.
To fix this problem, log off and then log back in. You will be in jail but you will not be Groggy.
