There's a lengthy discussion of this on another thread. Nobody owns an enemy, but it's still considerate to ask if you may join in. The person may be trying to level up, and receiving less rep for their efforts is just a waste of time. Although, the person could leave, crew up, or simply ask the other person to stop, rather than be rude themselves.

I know that I should ask to join them but I don't want to be told to leave. There are lots of places to level up too.
