I don't see why not. In most cases, this seems to be a perfectly reasonable solution. The only situation (It's a rare one, but it happened to pop in my head, so bear with me.) that would make this difficult would be if the GM was to disband the guild and would NOT want the guild to be continued. If someone was to create a guild with a similar name because "Oh! They're gone; we can use their name now. Yay!" (Beings they're probably amateurs who the original GM wouldn't want duplicating his or her guild), then, there could be a problem.
If the GM disbands because they left the game for good, or they were just tired of the guild, chances are, they probably won't care. But if the GM felt that a lot of work was put into the guild/the name has a lot of meaning/the guild name would still be boasted on a different game/whatever, then I guess they could plea plagiarism.
Here's where the real problem comes in: Would Disney actually accept the accusation? Technically, they're not in charge of the guild; they don't have the same influence over the name (in that game at least) as they did before when they were ACTUALLY leader. Not actually having the guild means no entitlement; anyone's free to use the guild name at will.
It's sad when someone resorts to using a guild name that's not their own, even if the guild is dead and gone (Not the song), but who could stop them if the guild IS gone?
