I like the idea of sailing under false colors. That's historically correct, and you'd have to raise the skull and crossbones before you could attack a ship at sea... by the pirate code me hearties.

I like the idea of higher reputation being associated with soldiers attacking you more often, after all your reputation follows you. Good ideas!

First idea being mine of course I like it, but yea I agree with you on the Reputation being how much you are noticed. There is no reason to call it your Rep or Notoriety if you get attacked by everyone at level 1 anyway. I say EARN THOSE ATTACKS MATIES!
