From April 2, 2010 Release Notes:
"Treasure Fleet ships will always drop at least one Loot Skull Chest when defeated."
This was not the case from then to whenever the update was made. I believe Disney has, indeed, been looking into this and has finally fixed it. Kudos to Big D. Now give me a Cerberus.
